Annual Meeting

 

Attorney Prior led the Board in the Pledge of Allegience.

 

Trustees Peckelis was sworn in for a two-year term by Attorney Prior.

 

Village Justice Elizabeth Kase was sworn in for a four-year term by Attorney Prior.

 

Nora Haagenson introduced Attorney Gale D. Berg to the Mayor and Board.

 

On motion of Trustee Peckelis, seconded by Trustee Haagenson, it was RESOLVED that Gale D. Berg be appointed as Acting Village Justice for a one-year term.

Village Attorney Prior swore Gale D Berg in as Acting Village Justice for a one-year term.

Public Hearing

Mayor Nicholson opened the public hearing duly advertised in the March 19, 2012 issue of the Port Washington News, to consider the adoption of the proposed budget for the fiscal year commencing June 1, 2012 and ending May 31, 2013.

Treasurer Tuck spoke about the Tentative and Tentative Revision Budgets.

Mayor Nicholson made the following appointments, subject to the approval of the Board of Trustees, for terms of one official year, said terms to expire April 2013.

Mayor Nicholson made the following appointment subject to the approval of the Board of Trustees, for a term of five years, said term to expire April 2017.

9:00PM Trustee Baldwin arrived.

 

Trustee Baldwin was sworn in for a two-year term by Attorney Prior.

 

On motion of Trustee Peckelis, seconded by Trustee Haagenson it was unanimously RESOLVED that the aforesaid appointments made by the Mayor be hereby approved.

Village Law Firm

On the motion of Trustee Peckelis, seconded by Trustee Baldwin, it was unanimously RESOLVED to appoint the law firm of Ackerman, Levine, Cullen, Brickman and Limmer, LLP to provide legal services for the Village for the year commencing April 2012 and ending May 2013 under the retainer agreement dated March 13, 2012, attached hereto. 

Official Village Newspaper

On the motion of Trustee Peckelis, seconded by Trustee Haagenson, it was unanimously RESOLVED that the Port Washington News be and hereby is designated as the official newspaper for the Village of Baxter Estates for the official year ending April 2013.

Depository Bank

On the motion of Trustee Peckelis, seconded by Trustee Haagenson, it was unanimously RESOLVED that the Bank of America be and hereby is designated as the official bank for authorized depositories for Village Funds.

Village Court Bank

On motion of Trustee Peckelis, seconded by Trustee Haagenson, it was unanimously RESOLVED that Chase Bank be and hereby is designated as the official bank for authorized depositories for Village Court Funds.

 

Meetings of the Board of Trustees

On the motion of Trustee Peckelis, seconded by Trustee Haagenson, it was unanimously RESOLVED that 315 Main Street, Port Washington, New York, be and hereby is designated as the place of the regular meetings of this Board until further notice and that the day and time of said regular meetings shall be 7:30PM, on the first Thursday of each month.

A.    Minutes

On motion of Trustee Peckelis, seconded by Trustee Haagenson, it was unanimously  RESOLVED that the reading of the minutes of the February 2, 2012 meeting of the Board of Trustees be waived and they be and hereby are approved  as presented by Clerk Whitcomb.

On motion of Trustee Peckelis, seconded by Trustee Haagenson, it was unanimously  RESOLVED that the reading of the minutes of the March 10, 2012 meeting of the Board of Trustees be waived and they be and hereby are approved  as presented by Clerk Whitcomb.

  Treasurer

A.  Abstract of Vouchers

On motion of Trustee Baldwin, seconded by Trustee Peckelis, it was unanimously RESOLVED that the Audited Vouchers dated April 5, 2012 for the General Fund totaling $ 22,863.10 be and hereby are approved as prepared by Treasurer Tuck.

B.   Procurement Policy

On motion of Trustee Baldwin, Seconded by Trustee Haagenson, it was unanimously RESOLVED to re adopt the present Village's Procurement Policy, as prepared and presented by Village Attorney Chris Prior.

A copy of the  policy is attached to these minutes.

C.      Capitalization Policy

On motion of Trustee Peckelis, seconded by Trustee Baldwin, it was unanimously RESOLVED that expenditures for furniture, fixtures and equipment for less than $1,000 be treated  as an expenditure and $1,000 or more be capitalized..

Tianderah Road

On motion of Trustee Baldwin, seconded by Trustee Peckelis, it was unanimously RESOLVED to re-open Tianderah Road to vehicular traffic on April 1, 2012.

            MS4 Annual Storm Water Meeting

                    Mayor Nicholson opened the Annual  MS4 Storm Water meeting and reported that a revised MS4 Annual Report will be posted on the NYDEC website. This form will be used to satisfy the 2011-2012 year reporting requirement. A discussion ensued and clerk Whitcomb was instructed to contact Sidney  B. Bowne and Son LLP to obtain a proposal for the Village’s Annual MS4 Stormwater Report.

            Special Budget Meeting

On motion of Trustee Haagenson , seconded  by  Trustee Baldwin it was unanimously resolved to hold a Special Meeting on April 12, 2012 at 6:00PM to modify and adjust the tentative budget for the year commencing June 1, 2012 and ending May 31, 2012.

            Maintenance of Village Property

On motion of Trustee Baldwin, seconded by Trustee Haagenson, it was RESOLVED to solicit, within the next ten days, proposals for the maintenance of various village properties from at least three contractors.

There being no further business before the Board, on motion of Trustee Haagenson, seconded by Trustee Baldwin, it was unanimously RESOLVED that the meeting be and hereby is closed at 11:20PM.
