Also present:  James and Marilyn Sacrestano, Walter Hinck, Kathleen Lanzone, Mary

                        Demelas, Janet Demelas, Susan Smith, William Helmers III.

 

Mayor Nicholson opened the meeting at 7:30PM, with the Pledge of Allegiance led by Trustee Taylor.

 

 

1.                    New Business

 

A.      James Sacrestano, 15 Hillside Avenue

 

James Sacrestano addressed the Board requesting that the resolution attached to the minutes of the July Board of Trustees meeting be amended.  Attorney Prior stated that he would do so.

 

B.       Walter Hinck, 30 Locust Avenue

 

Walter Hinck addressed the Board and requested a speedy resolution to his fence dispute which has been ongoing since 2006.  Attorney Prior stated that he would consult the Building Inspector and Village Prosecutor and ascertain where the issue stood.  He will inform the clerk who will then inform Mr. Hinck.

 

C.      Mary and Janet Demelas, 52 Sandy Hollow Road

 

Mary Demelas and Janet Demelas informed the Board that the retaining wall behind their house was in poor condition and requested that the neighbors behind them be informed and made to repair it as soon as possible.

 

D.      Kathleen Lanzone, 7 Ridgeway Road

 

Kathleen Lanzone addressed the Board, stating that the neighbor across the street was conducting a business from their house and requested that they be made to desist.

 

On motion of Trustee Baldwin, seconded by Trustee Peckelis, the Board voted unanimously at 8:30 pm to enter into Executive Session.

At 8:50 pm, the Mayor stated that Executive Session had concluded, and that no action had been taken by the Board in Executive Session.

E.       Michael Marmor

Michael Marmor requested that the Village review their curbing repair policy and stated that he had never received his approved fence permit.  Clerk Whitcomb showed him the approved application.  The Board requested that Clerk Whitcomb issue a Fence Permit in future for all applications for new or replacement fences.

 

E.        William Helmers III, 20 High Street

 

William Helmers III stated he wished to bring the Board’s attention to vagrants in Baxter Pond Park.  Mayor Nicholson said that the Board was aware of the problem and that he had spoken with Tony Guzzello of the Port Washington Police on the matter of the increasing homeless presence in Port Washington.

 

F.      Justice Court

 

RESOLUTION OF BOARD OF TRUSTEES

OF THE VILLAGE OF BAXTER ESTATES

ADOPTED NOVEMBER 4, 2010, WITH

RESPECT TO AUDIT OF

VILLAGE JUSTICE COURT RECORDS

 

 

WHEREAS, pursuant to Section 2019-a of the Uniform Justice Court Act, the Board of Trustees of the Village is required to confirm that the records and dockets of the Village Justice Court be audited, and that the fact of that auditing be reflected in the minutes of the proceedings of this Board, and

 

WHEREAS, the Village Board has caused the independent auditing firm Skinnon, Faber & Heck, CPA, P.C. (the “Auditor”), to audit and examine the records and dockets of the Village Justice Court, and

 

WHEREAS, the Auditor has submitted to the Village its report dated October 21, 2010 of the records of the Village Justice Court required under Uniform Justice Court Act § 2019-a (the “Justice Court Audit Report”), and

 

WHEREAS, the Village Board desires to comply with the Uniform Justice Court Act § 2019-a, and to reflect in the minutes of its proceedings that such audit has occurred,

 

            NOW, THEREFORE, IT IS HEREBY:

 

RESOLVED, that the Board of Trustees of the Village of Baxter Estates does hereby acknowledge that the audit of the records of the Village Justice Court required under Uniform Justice Court Act § 2019-a has been conducted, and that the Justice Court Audit Report has been received by the Board, and it is hereby further,

 

RESOLVED, that the Village Clerk forward to the New York State Office of Court Administration a copy of said Justice Court Audit Report and a copy of this Resolution. 

 

G.     Village Catch Basin Cleaning

 

On motion of Trustee Baldwin, seconded by Trustee Peckelis, it was unanimously RESOLVED that the Village Catch Basins be cleaned, for a sum not to exceed $6,000.00.  Clerk Whitcomb will solicit proposals.

On motion of Trustee Baldwin, seconded by Trustee Peckelis, it was  unanimously RESOLVED that the reading of the minutes of the July 15, 2010 Board of Trustees Meeting be waived and they be and hereby are approved as presented by Clerk Whitcomb.

On motion of Trustee Baldwin, seconded by Trustee Peckelis, it was  unanimously RESOLVED that the reading of the minutes of the September 15, 2010 Board of Trustees Meeting be waived and they be and hereby are approved as presented by Clerk Whitcomb.

 

 

 

On motion of Trustee Baldwin, seconded by Trustee Peckelis, it was  unanimously RESOLVED that the reading of the minutes of the October  7, 2010 Board of Trustees Meeting be waived and they be and hereby are approved as amended and presented by Clerk Whitcomb.

 

3.         Treasurer

A.     Abstract of Vouchers

On motion of Mayor Nicholson, seconded by Trustee Peckelis, it was unanimously RESOLVED that the audited vouchers presented by Treasurer Tuck, dated November 4, 2010 for the General Fund totaling $ 54,442.06 be and hereby are approved.

 

 

There being no further business before the Board, on motion of Trustee Baldwin, seconded by Trustee Peckelis, it was unanimously RESOLVED that the meeting be and hereby is adjourned at 11:30pm.
