Public Hearing 7:35PM

 

Deputy Mayor Comer opened the public hearing duly advertised in the March 7, 2014 issue of the Port Washington News with respect to Bill 1 of 2014, a local law to authorize the Village of Baxter Estates to authorize a property tax levy in excess of the limit established in New York State General Municipal Law § 3-c, within the Village.

On motion of Trustee Baldwin, seconded by Trustee Haagenson, it was unanimously RESOLVED to close public hearing on Bill 1 of 2014.

 

Public Hearing 7:46PM

 

Deputy Mayor Comer opened the public hearing duly advertised in the March 20, 2014 issue of the Port Washington News to consider the Budget for the fiscal year commencing June 1, 2014 and ending May 31, 2015.

On motion of  Trustee Baldwin, seconded by Trustee Peckelis, it was unanimously RESOLVED to close public hearing on the Budget.

 

 

 

Annual Meeting 8:00PM

 

Trustee Douglas Baldwin was sworn in for a two-year term by Attorney Prior.

Trustee  Alice Peckelis was sworn in for a two-year term by Attorney Prior.

 

Appointment

 

Deputy Mayor Comer made the following appointment, subject to the approval of the Board of Trustees, for a term of one year, said term to expire April 2015.

 

Acting Justice Gale D. Berg

 

Acting Justice Gale D. Berg was sworn in for a one-year term by Attorney Prior.

 

On motion of Trustee Haagenson, seconded by Trustee Baldwin, it was unanimously RESOLVED that the aforesaid appointment made by  Deputy Mayor Comer be hereby approved.

 

Village Law Firm

On motion of Trustee Baldwin, seconded by Trustee Peckelis, it was unanimously RESOLVED to appoint the law firm of Ackerman, Levine, Cullen, Brickman & Limmer, LLP to provide legal services for the Village’s 2014/2015 year under the retainer agreement dated March 20, 2014 attached hereto.

Official Village Newspaper

On motion of Trustee Baldwin, seconded by Trustee Peckelis, it was unanimously RESOLVED that the Port Washington News be and hereby is designated as the official newspaper for the Village of Baxter Estates for the official year ending April 2015.

Depository Bank

On motion of Trustee Baldwin, seconded by Trustee Peckelis, it was unanimously RESOLVED that the Bank of America be and hereby is designated as the official bank for authorized depositories for Village Funds for the year ending April 2015.


Village Court Bank

On motion of Trustee Baldwin, seconded by Trustee Peckelis, it was unanimously RESOLVED that Chase be and hereby is designated as the official bank for authorized depositories for Village Court Funds for the year ending April 2015.

Meetings of the Board of Trustees

On motion of Trustee Baldwin, seconded by Trustee Peckelis, it was unanimously RESOLVED that 315 Main Street, Port Washington, New York be and hereby is designated as the place of the regular meetings of this Board until further notice and that the day and time of said regular meetings shall be 7:30PM, on the first Thursday of each month.

Local Law 1 of 2014

On motion of Trustee Baldwin, seconded by Trustee Haagenson, Bill No. 4 of 2013, establishing Site Plan regulation, was unanimously adopted as  Local Law 1 of 2014.

Local Law 2 of 2014

On motion of Trustee Baldwin, seconded by Trustee Haagenson, Bill No. 1 of 2014, the property tax levy cap override legislation, was unanimously adopted as Local Law 2 of 2014.

Village Budget

On motion of Trustee Peckelis, seconded by Trustee Baldwin, it was unanimously RESOLVED to adopt the tentative budget as presented as the budget  for the Village fiscal year commencing June 1, 2014 and ending May 31, 2015, in the amount of  $697,648.00.

New Business

1.      Village Clerk

On motion of Trustee Baldwin, seconded by Trustee Haagenson, it was unanimously RESOLVED that the reading of the minutes of the March 6, 2014 Meeting of the Board of Trustees be waived and they be, and hereby are, approved as presented by Clerk Whitcomb.

             2.     Treasurer 

A.      Abstracts of Vouchers

On motion of Trustee Baldwin, seconded by Trustee Haagenson, it was unanimously RESOLVED that the Abstract of Audited Vouchers, dated April 3, 2014, for the General Fund, totaling $104,148.50, be and hereby is approved as prepared by Treasurer Tuck. 

3.      Budget Modification 2014-2015

On motion of  Deputy Mayor Comer, seconded by Trustee Baldwin, it was unanimously RESOLVED to adopt the modified budget as presented by Treasurer Tuck.

4.       MS4 Annual Storm Water Report

Deputy Mayor Comer reported that the Annual Report for the year 2013-2014 was available.

5.      Village  Landscaping/Tree maintenance

On motion of Trustee Baldwin, seconded by  Deputy Mayor Comer, it was unanimously RESOLVED to approve Robert Keogh to trim dead limbs and address safety issues for an amount not to exceed $1,200.00.

6.      Village Hall

On motion of  Deputy Mayor  Comer, seconded by Trustee Baldwin, it was unanimously RESOLVED to add shelving to the basement file room for an amount not to exceed $500.00.

7.     Village Beach Maintenance

On motion of Trustee Haagenson, seconded by Trustee Baldwin, it was unanimously RESOLVED to  accept the proposal of  Robert Keogh for Baxter Beach maintenance in the amount of  $1,400.00.

8.          Village Hall Property Line Easement

Village Attorney Christopher Prior presented a revised form of the “Ball Field Easement” granted by the Village to the Port Washington Water Pollution Control District in connection with the closing in 2013 on the Village purchase of the premises at 315 Main Street. The easement amendment reflects the re-positioning of the fence and retaining wall that constitutes an outfield wall for the abutting ball fields. 

On motion of  Deputy Mayor  Comer, seconded by Trustee Baldwin it was unanimously RESOLVED to approve the amended  Ball Field easement as presented by Village Attorney Chris Prior, for execution and delivery by Mayor Nicholson on behalf of the Village.

9.      Peckelis-I Hilltop Road

On motion of Trustee Baldwin, seconded by Deputy Mayor  Comer, with Trustee Peckelis  recusing herself,  it was unanimously RESOLVED, by those voting , to amend the resolution of December 5, 2013 to authorize extension of Building Permit 13A 2012 issued to Joseph and Alice Peckelis, to expire on December 31, 2014.

10.     Procurement Policy

On motion of  Deputy Mayor Comer, seconded by Trustee Haagenson, it was unanimously RESOLVED to re-adopt the Village’s Procurement Policy, as prepared and presented by Village Attorney Chris Prior.(Attached hereto)

11.     Capitalization Policy

On motion of  Deputy Mayor Comer, seconded by Trustee Baldwin, it was unanimously RESOLVED that the expenditures for furniture, fixtures and equipment for less than $1,000.00 be treated as an expenditure and $1,000.00 or more be capitalized.

12.     Investment Policy 2014

On motion of  Deputy Mayor  Comer, seconded by Trustee Baldwin, it was unanimously RESOLVED to renew the Village’s Investment Policy for one year. 2014-2015.

 

There being no further business before the Board, on motion of  Deputy Mayor  Comer, seconded by Trustee Baldwin, it was unanimously RESOLVED that the meeting be and hereby is closed at 11:45  PM.
